Terms of Service
Last updated October 14, 2026
These terms are an agreement between you and Particular ("we", "us"), which operates studioHYPE. By creating an account or using studioHYPE, you agree to them. If you use studioHYPE for a studio or business, you agree on its behalf and confirm you have the authority to do so; "you" then means that studio too.
The service
studioHYPE helps youth activity studios plan and run their marketing: leads and families, calendars and campaigns, social posts, email, automations, reports, an AI strategist, a resource library, and a studio owner community. We may add, change, or retire features over time. If we remove something important you rely on, we will tell you in advance when we reasonably can.
Accounts
- You must be at least 18 and give accurate information when you sign up.
- Keep your password secure and tell us right away if you think someone else has used your account. You are responsible for what happens in your account.
- The studio's owner controls who on the team has access and what each person can do. Team members use studioHYPE on the studio's behalf.
Plans and billing
- Paid plans are billed in advance through Stripe, monthly or yearly, and renew automatically until cancelled.
- You can cancel at any time in Settings → Billing. Cancelling stops the next renewal; you keep access until the end of the period you paid for. Payments are non-refundable except where the law requires otherwise.
- Plans may include limits, such as a monthly AI allowance. When a limit is reached, the feature pauses until the next period or an upgrade.
- We may change prices with at least 30 days' notice; the new price applies from your next renewal.
- If a payment fails and isn't fixed, we may limit the account after giving you notice.
Your data
- Everything your studio puts into studioHYPE (families, students, leads, content, files, and so on) belongs to you. You give us permission to store, process, and display it only to provide and improve the service for you, as described in our Privacy Policy.
- You are responsible for having the right to the information you add, including information about families and the students you teach, and for telling families how you use it.
- You can export or delete your data, and ask us to delete your account, at any time.
Email and messaging
When you send email through studioHYPE, you are the sender and you agree to:
- Email only people who have a relationship with your studio (families, students' guardians, and people who asked about your programs). Never buy, rent, or scrape email lists.
- Follow anti-spam laws such as CAN-SPAM and CASL: use honest subject lines, keep your mailing address in your emails, and honor unsubscribes. studioHYPE adds the unsubscribe link and address for you; don't remove or hide them.
- Keep bounces and spam complaints low. To protect deliverability for every studio, we may pause a studio's sending when its bounce or complaint rate is too high, until the cause is fixed.
Acceptable use
Don't use studioHYPE to:
- Break the law or anyone's rights, including privacy and intellectual property rights.
- Send spam, harassment, hateful or sexually explicit content, or anything harmful to children.
- Upload malware, try to get into other studios' data, probe or overload the service, or get around its limits.
- Copy, resell, or build a competing product from studioHYPE.
We may remove content or suspend an account that breaks these rules. Where we reasonably can, we will tell you first and give you a chance to fix it.
Connected services
studioHYPE can connect to Facebook, Instagram, Canva, Stripe, Zapier, your registration software, and other services. Your use of each is also governed by that service's own terms and policies, including Meta's Platform Terms and Community Standards for anything published to Facebook or Instagram. We are not responsible for those services, and features that depend on them may change or stop if they change their products or access.
AI features
AI drafts, suggestions, and recommendations are starting points. They can be wrong or incomplete. Review everything before you publish or send it; you are responsible for what goes out under your studio's name. You own the content you create with AI in studioHYPE, subject to the rights of others in anything you put in.
Community
The studio owner community lets studio owners and staff share ideas and resources with each other. Be respectful, don't share families' or students' personal information, and post only what you have the right to share. By posting, you let other members view and use what you shared for their own studios. We may moderate or remove posts that break these terms.
Our property
studioHYPE, including its software, design, built-in templates, and resource library, belongs to us and our licensors. We give you a limited, non-transferable right to use it for your studio while your account is active. Built-in templates and resources may be used and adapted for your own studio's marketing. If you send us feedback or ideas, we may use them without obligation to you.
Ending
You can stop using studioHYPE and close your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms or don't pay, or if we stop offering the service (with reasonable notice in that case). After an account closes, you have 30 days to ask for an export of your data; we then delete it as described in the Privacy Policy.
Disclaimers
studioHYPE is provided "as is" and "as available". We work hard to keep it running and accurate, but we don't promise it will be uninterrupted, error-free, or that it will produce any particular marketing or enrollment result. To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Liability
To the extent the law allows, neither we nor our suppliers are liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, and our total liability for any claim relating to studioHYPE is limited to the amount you paid us in the 12 months before the claim. You agree to cover our reasonable costs from claims caused by content you send or publish through studioHYPE or by your breach of these terms.
General
- We may update these terms. We will post the new version here and, for significant changes, email studio owners at least 30 days before they take effect. Continuing to use studioHYPE after that means you accept them.
- These terms are governed by the laws of the United States and of the state where Particular has its principal place of business, without regard to conflict-of-law rules.
- If part of these terms can't be enforced, the rest still applies. Not enforcing a right is not a waiver of it. You may not transfer these terms without our consent; we may transfer them as part of a merger or sale of our business.
- These terms and the Privacy Policy are the whole agreement between us about studioHYPE.
